RetkiRent Terms of Use

These Terms of Use apply to the use of the RetkiRent service.

RetkiRent is an online marketplace operated by Raylab Oy, where users can offer equipment, gear, products and services related to hiking, outdoor activities and nature-based recreation for rent, sale, exchange, request or giveaway.

By using the RetkiRent service, the user accepts these Terms of Use.

1. The RetkiRent service

RetkiRent operates as a marketplace between users. Through the service, users can publish listings, communicate with one another, and make arrangements related to rentals, sales and other listings.

RetkiRent is not a party to rental, sales or service agreements between users unless otherwise agreed in writing.

The service may also include products and services offered by parties other than RetkiRent. The provider of such products or services is responsible for them.

2. Registration and user account

The service is available to individuals who are at least 18 years old and legally entitled to enter into binding agreements. Making paid bookings or purchases requires a valid payment method.

Users must provide accurate, up-to-date and sufficient information when registering. Users are responsible for keeping the information connected to their user account up to date.

A user account is personal. Users may not give their username or password to another person.

Users are responsible for the use of their own user account and for keeping their login details confidential. Users must notify RetkiRent without delay if they suspect unauthorised use of their account.

RetkiRent may use an invitation-based registration process in order to maintain the safety and quality of the community.

3. Listings and user responsibility

Users are responsible for ensuring that the listings, information, images, prices, availability details and other content they publish are accurate, up to date and lawful.

Users are responsible for ensuring that they have the right to offer the product, equipment or service stated in their listing for rent, sale, exchange, request or otherwise to other users.

Users are responsible for ensuring that any product offered for rent or sale is safe, suitable for its intended purpose and in appropriate condition.

Users are responsible for ensuring that they have the right to use the content they add to the service and grant RetkiRent the right to use it as described in these Terms of Use, including any images, texts, trademarks and other materials.

Users must not provide materially inaccurate or misleading information in a listing concerning a product, service, price, availability, condition, ownership or any other matter relevant to the listing.

4. Business users and private individuals

If a user offers products or services in the course of business, they must act in the service as a business user.

Each listing must clearly indicate whether the provider is a private individual, a company or another trader.

Business users are responsible for ensuring that their listings, products, services, prices, terms and business practices comply with consumer protection legislation and other applicable laws.

Business users must provide customers with the information required by applicable law, such as the company name, contact details, essential information about the product or service, the price including taxes, and any applicable delivery, cancellation and contract terms.

A private individual may not present themselves as a business, and a company or other trader may not present themselves as a private individual.

5. Content and rights of use

Users retain ownership and rights to the content they add to the service.

Users grant RetkiRent a free, non-exclusive right to use, store, display, publish, copy, technically modify and distribute content added to the service for the purpose of providing, maintaining, developing and marketing the service.

This includes the right to publish listings, listing images, texts, titles, prices and other public listing information on RetkiRent’s website, newsletters and social media channels, including automatically.

RetkiRent has the right to remove, hide or technically modify content that is contrary to these Terms of Use, the law, good practice or the safety of the service.

Users may not add content to the service that infringes the copyrights, trademarks, privacy or other rights of a third party.

6. Bookings, payments and service fees

RetkiRent’s booking and payment system must be used for all rentals and for sales transactions where RetkiRent’s payment service is available.

Bypassing RetkiRent’s payment system, sending external payment links or directing users to make payments outside the service is prohibited unless RetkiRent has given written permission.

For paid transactions completed through RetkiRent’s payment system, RetkiRent charges the owner or seller a service fee of 15% of the transaction amount, with a minimum fee of EUR 2. The service fee includes the applicable value-added tax.

Free listings for sales between private individuals may be published through RetkiRent. In these listings, RetkiRent does not process the payment and is not a party to the sale. The buyer and seller agree directly on payment, handover, delivery, returns and any disputes.

Payment processing, the rental agreement and other protections offered in connection with paid transactions through RetkiRent’s payment system do not apply to free listings for sales between private individuals.

External payment service providers may be used for payments and payouts. Users must also comply with the terms of the relevant payment service provider.

RetkiRent’s rental agreement and the rental-related protection offered through the service apply only when both the booking and payment are completed through RetkiRent’s own booking and payment system.

7. Bypassing the payment system

If users who have found each other through RetkiRent agree on a paid rental or paid sale outside RetkiRent’s booking and payment system without RetkiRent’s written permission, the owner or seller must notify RetkiRent of this without delay.

In such a situation, RetkiRent may charge the owner or seller the normal service fee for the completed transaction. The fee is 15% of the transaction amount, with a minimum fee of EUR 2. The service fee includes the applicable value-added tax.

RetkiRent may provide a payment link or invoice for payment of the service fee.

The service fee may be charged where RetkiRent has reasonable evidence that the users found each other through RetkiRent and knowingly bypassed RetkiRent’s booking and payment system.

Before charging the service fee, the user will be given an opportunity to provide an explanation.

This section does not apply to free listings for sales between private individuals where RetkiRent does not process the payment.

8. Rentals, sales and agreements between users

The owner, renter, seller and buyer agree directly with each other on matters relating to rental, sale, handover, return, delivery, collection, use and possible damage.

Before making a booking or payment, users should review the information in the listing and, where necessary, ask the other user for further details.

The owner or seller is responsible for ensuring that listing information corresponds to the product or service as accurately as possible.

The renter or buyer is responsible for using the product carefully, appropriately and in accordance with any instructions for use.

Users must notify each other without delay of any damage, defects, delays or other issues.

9. Safe and fair use

RetkiRent is a community where users can rent, sell, buy and share outdoor equipment and services safely and fairly.

Users are expected to act honestly, appropriately and respectfully towards other users. Listings, messages and other information added to the service must be accurate, clear and lawful.

Always use RetkiRent’s booking and payment system when it is available for the listing. Do not send external payment links to other users or request login details, payment details or personal data through messages.

Keep your user account and login details for your own use. If you notice suspicious activity, a scam attempt or content that may endanger the safety of the service, notify RetkiRent without delay.

Users must not:

• publish materially inaccurate, misleading, offensive or rights-infringing content
• publish another person’s personal data without an appropriate right to do so
• use another person’s user account without permission
• send spam, mass messages, phishing messages, misleading payment requests, external payment links or harmful links
• attempt to obtain users’ login details, payment details or personal data without authorisation
• direct users to payment systems outside RetkiRent without RetkiRent’s written permission
• use the service for fraud, scams or other misuse
• disrupt the operation of the service or attempt to bypass its technical or security-related functions
• publish content that incites violence, crime or discrimination
• publish inappropriate content involving minors

10. RetkiRent’s right to intervene in misuse

RetkiRent may remove a listing, message or other content, restrict a user’s access to the service or close a user account if the user breaches these Terms of Use, the law or good practice; endangers the safety of other users or the service; provides materially inaccurate information; uses the service for phishing, scams, spam or other misuse; attempts to bypass RetkiRent’s booking or payment system; or infringes the rights of another person or entity.

In urgent security or fraud-related situations, RetkiRent may take action immediately.

RetkiRent will seek to notify the user of a restriction of access, closure of an account or removal of content, as well as the reason for the action, unless notification would endanger security, the investigation of misuse, the rights of other users or compliance with the law.

11. RetkiRent’s responsibility and limitation of liability

RetkiRent provides a technical marketplace for rentals, sales and communication between users.

RetkiRent is not responsible for the accuracy of information provided by users to each other, agreements between users, the condition, quality, safety or suitability of products, or the actions of users.

RetkiRent does not guarantee that the service will operate without interruption or errors. The service may be affected by technical issues, maintenance breaks or other circumstances affecting its use.

RetkiRent seeks to maintain the safety and functionality of the service, but users must always assess the reliability of another user, listing, product and agreement before making a payment, booking or handover.

RetkiRent is not responsible for disruptions to the operation of the service caused by force majeure or another comparable reason beyond RetkiRent’s reasonable control.

Nothing in these Terms of Use limits RetkiRent’s liability to the extent that liability cannot be limited under applicable law.

12. Privacy

RetkiRent processes personal data in accordance with its Privacy Policy.

Messages exchanged between users are stored in the service. RetkiRent may process messages only where necessary for customer service, security, investigation of misuse, dispute resolution or enforcement of these Terms of Use.

Information added by users to their profile or listings may be visible to other users and, depending on the service settings, also to visitors to the service.

13. Changes to the Terms of Use

RetkiRent may update these Terms of Use where necessary due to service development, security, payment methods, changes in legislation, authority guidance or another justified reason.

Users will be informed of material changes within a reasonable period before they take effect, for example through the service or by email.

If a user continues to use the service after the amended Terms of Use have entered into force, the user accepts the updated Terms of Use.

14. Applicable law and dispute resolution

These Terms of Use are governed by Finnish law.

Any disputes will primarily be resolved through negotiations between RetkiRent and the user.

Consumers may, where appropriate, contact consumer advisory services or submit the matter to the Finnish Consumer Disputes Board.

A dispute may be brought before a competent court in accordance with applicable law.
